1. Introduction

Swagarific ("we", "us", or "our") is operated by Bingwah Systems. This Privacy Policy explains what personal information we collect when you use our website and services, how we use it, and the choices you have. By using Swagarific you agree to the practices described here. Please also read our Terms & Conditions.

2. Information We Collect

We collect information in the following ways:

  • Account information: your email address, username, full name, profile photo and bio, and a securely hashed password. If you sign in with Google, Facebook or Twitter/X, we receive your name, email address and profile picture from that provider.
  • Content you post: trends and style posts, comments, likes, and product listings including photos, videos, descriptions and prices.
  • Order and delivery information: items you buy or sell, your shipping name, phone number and address, order notes, and order history. Sellers receive the delivery details needed to fulfil your order.
  • Payment information: payments are processed by Paystack. We do not receive or store your card or mobile-money details; we only receive the payment reference and whether the payment succeeded.
  • Messages you send us: the name, email address and message you submit through our contact form.
  • Technical information: an IP address is used to protect our forms from abuse, and our servers keep ordinary logs needed to operate and secure the service.

3. How We Use Your Information

  • To create and secure your account and sign you in
  • To run the marketplace: listings, carts, orders, payments and delivery
  • To display your posts, comments and listings to other users
  • To send service emails such as password reset links
  • To respond to your questions and support requests
  • To detect fraud, abuse and security problems, and to enforce our Terms
  • To comply with legal obligations

We do not sell your personal information, and we do not use it for third-party advertising.

4. What Other Users Can See

Your username, profile photo, bio, posts, comments and product listings are visible to other users and visitors. Your email address, password and payment details are never shown publicly. If you sell items, buyers see your username and shipping-from location.

5. Who We Share Information With

We share information only with service providers that help us run Swagarific:

  • Paystack to process payments
  • Amazon Web Services (S3) to store images and videos
  • Google, Facebook and Twitter/X if you choose to sign in with them
  • Our email delivery service to send you service emails such as password reset links
  • Our hosting and database providers that store and serve the service
  • Sellers and buyers you transact with, limited to what is needed to complete the order

We may also disclose information when required by law or to protect the rights, safety and property of our users and the Platform.

6. Cookies

We use only the cookies needed to run the service: a session cookie that keeps you signed in and a security cookie that protects sign-in forms. We do not use advertising or cross-site tracking cookies. You can block cookies in your browser, but you will not be able to sign in.

7. Data Retention

We keep your account information while your account is active. Order records are kept for as long as needed for accounting, dispute resolution and legal requirements. Password reset links expire after one hour, and contact-form rate-limit records are deleted automatically after 30 days. If you ask us to delete your account, we remove or anonymise your personal information unless we are required to keep it.

8. Security

We protect your information with measures such as hashed passwords, encrypted connections (HTTPS), expiring single-use reset links and access controls. No system is completely secure, so please use a strong, unique password and keep it private.

9. Your Rights

Under applicable data protection law, including the Kenya Data Protection Act, 2019, you may have the right to:

  • Access the personal information we hold about you
  • Correct inaccurate or incomplete information (you can edit your profile at any time)
  • Request deletion of your information
  • Object to or restrict certain processing
  • Receive a copy of your information in a portable format
  • Complain to the Office of the Data Protection Commissioner

10. International Transfers

Some of our providers, such as cloud hosting and storage, may process data outside Kenya. When this happens we rely on providers that apply appropriate safeguards for your information.

11. Children

Swagarific is not intended for anyone under 18. We do not knowingly collect personal information from children. If you believe a child has given us their information, contact us and we will delete it.

12. Changes to This Policy

We may update this policy from time to time. We will change the "Last Updated" date above and, for significant changes, notify you on the Platform or by email.
